In August, 2014, Stacy Fulco published an article in the DRI In-House Quarterly: “Don’t Let Your Manual be a Liability: The Danger of Security.” When litigation is filed that involves a security issue or event, the security manual is placed under a microscope. Unfortunately, this often creates problems because many security manuals have not been drafted to withstand the scrutiny of litigation. Language within the manual can create either actual or inferred heightened duties. The article discusses the hidden dangers of security manuals and provides suggestions for drafting such manuals.
