John Lynch and Jon Ibarra secured summary judgment for their client, a children’s museum, in a premises liability case in which the plaintiff claimed severe personal injuries when she allegedly slipped and fell in the museum. They argued that the plaintiff could not establish actual or constructive notice of any alleged hazard that caused or contributed to her fall, or even the cause of her alleged accident. The circuit court agreed and granted summary judgment for the defendant. The court’s decision was not appealed.
