John P. Lynch obtains Summary Judgment for Trucking Company

John Lynch secured summary judgment for his client, a trucking company, in a case in which the plaintiff sustained multiple injuries when a bundle of conduit fell onto him from a load he had delivered as it was being unloaded. The plaintiff sued the shipper and the consignee, who then sued the trucking company as a third party defendant. John successfully argued that the plaintiff was an independent contractor and, therefore, the trucking company owed him no duty to prevent him from harm during the unloading process. He also argued that there was no evidence that his client had caused or contributed to the accident in any way.  The court agreed and granted summary judgment for their client.
