Stacy Fulco and Chris Clanin represented a grocery store in DuPage County, Illinois and the plaintiff claimed he slipped and fell in a large puddle of a thick, clear substance near the store entrance. The plaintiff slipped just after entering the store so he did not know how long the puddle was present and he did not know the source of the substance. A store employee testified he did not see anything on the floor after the incident but a scuff mark. He also stated the store did not have formal inspection policies but the area at issue would have typically been inspected by employees 3 times an hour, or every twenty minutes. Based on that testimony, the court ruled there was no basis to find the store had constructive notice of the substance and summary judgment was granted.
